Consultation / Meet & Greet Disclaimer
DISCLAIMER: THIS CONSULTATION IS FOR INFORMATION AND EDUCATION ABOUT TRICKS FOR TREATS ONLY. THERE IS NO PROMISED TRAINING INCLUDED WITH THIS CONSULTATION. THE INFORMATION CONTAINED IN THIS CONSULTATION DOES NOT CONSTITUTE THE RENDERING OF VET / HEALTH ADVICE OR THE PROVISION OF TREATMENT OR TREATMENT RECOMMENDATIONS. ATTENDING THIS CONSULTATION DOES NOT ESTABLISH A PROFESSIONAL RELATIONSHIP WITH TRICKS FOR TREATS OR ANY MEMBER OF OUR STAFF. ANY MEDICAL OR VET / HEALTH CARE RELATED DECISION SHOULD BE MADE IN CONSULTATION WITH YOUR QUALIFIED HEALTHCARE PROVIDER. Liability for Potential Harm Caused By or To Dog
If Dog causes property damage, or bites or injures to any dog, animal or person (including but not limited to owners, trainers, example dogs, other clients, other clients dogs, or employees), during or after the term of this Agreement, then this client agrees to pay all resulting losses and damages suffered or incurred, and to defend and compensate Tricks For Treats owners, trainers, or employees, and/or agents from any resulting claims, demands, lawsuits, losses, costs, medical expenses, lost wages, or expenses, including attorney fees.
If Dog is injured in an accident or fight, gets sick during or after spending time with Tricks For Treats owners, trainers, or employees, or is harmed in any other manner during or after the term of the Agreement, Client assumes the risk and agrees that Trainer should not be held responsible for any resulting injuries, illness, losses, damages, costs or expenses, even if that harm is caused in part by the negligence or carelessness of Tricks For Treats trainers or employees, unless it is caused by the gross negligence or the intentional misconduct of Tricks For Treats owners, trainers, or employees. This liability waiver and release extends to Tricks For Treats together with all owners, trainers, and employees.
Liability for Potential Harm Caused to Client or Client’s Property

I understand that Tricks For Treats is a dog training company and its sole purpose is the training and education of pets and pet owners.

I knowingly and voluntarily assume all of the risks inherent in engaging in dog training, including those that may not be specifically enumerated herein.

I understand the risk of injury from the activities involved is significant, including the potential for permanent disfigurement, equipment and personal discipline reduce this risk however the risk of serious injury does exist.

I also understand that among these risks is the possibility that I may get sick, including but not limited to with COVID-19. I acknowledge the contagious nature of the COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. I acknowledge that Tricks For Treats can not guarantee that I will not become infected with the COVID-19. I voluntarily seek services provided by Tricks For Treats and acknowledge that I am increasing my risk of attracting COVID-19 by doing so.

I knowingly and freely assume all such risks, both known and unknown, and assume full responsibility for me and my dog’s participation.

I willingly agree to comply with the stated instructions and policies and customary terms and conditions for participation.

I agree that I will not attend any Tricks For Treats events or host Tricks For Treats on my premises (property) if I believe I, or anyone in my household or with whom I have regular contact, has (a) contracted or is suspected to have contracted COVID-19 and have not yet been cleared as non-contagious by a medical provider, or (b) been exposed to a suspected or confirmed case of COVID-19 within the last 14 days.

If I observe any unusual significant hazard during my presence or participation in training with Tricks For Treats, I will remove myself from participation and bring such to the attention of Tricks For Treats owners, trainers, or employees.

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, indemnify and hold Tricks For Treats, and their owners, trainers, officers, officials, agents, clients and/or employees harmless with respect to any and all injury, illness, disability, death, or loss or damage to person or property, even if that injury, illness or other loss is caused in part by the negligence or carelessness of Tricks For Treat’s agents, unless it is caused by the gross negligence or the intentional misconduct of Tricks For Treat’s agents. This liability waiver and release extends to Tricks For Treats together with all owners, trainers, and employees.
Medical Emergencies Waiver
In the case of a medical emergency where Client is not present and/or cannot be reached, Tricks For Treats Trainer shall have the right to bring Dog to a veterinarian for treatment and to use our judgment (and rely on the judgment of said veterinarian) to authorize medical procedures in the Dog's best interest. Client agrees they will pay any medical bills or other costs associated with veterinary care which are provided during the time during which they could not be reached.
Trainer’s Option to Terminate Agreement in Case of Problems with Dog or Client Agreement
At Trainer’s sole election, Trainer’s duties and Tricks For Treats responsibility to train hereunder shall terminate if (a) in Trainer’s sole judgment Dog is dangerous or vicious to Trainer or any other person or animal, or interferes with the training of other dogs, or (b) Client breaches any term or condition of this Agreement, consistently fails to follow Trainer instructions, or refuses to comply with the stated instructions and policies and customary terms and conditions for participation, including Trainer’s policies and procedures. Upon termination in accordance with the foregoing, (c) in Trainer’s sole judgment Dog is not going to make progress under his/her training and the dog is therefore deemed unworkable, untrainable, or uncontrollable.
I understand and agree that In this event, Tricks For Treats responsibility to train and trainer’s duties shall terminate, and that all other provisions of this Agreement shall continue in full force and effect.

Training Outcomes Not Guaranteed Agreement
I agree that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to Dog or anything else. Without limiting the generality of the foregoing, Client acknowledges that Trainer has not represented, promised, guaranteed, or warranted that Dog will never bite, that Dog will not be dangerous or vicious in the future, that Dog will not exhibit other behavioral problems, that the dog will be fully trained, or that the results of the training will last for any particular amount of time.
I understand Tricks For Treats owners, trainers, and employees will make every reasonable effort to help Client achieve training and behavior modification goals but make no guarantee of Dog’s performance or behavior as a result of providing professional dog training.
I understand that he/she and members of the household must follow Trainer’s instructions without modification, work with the dog daily as recommended, and constantly reinforce training being given to the dog.
I understand that training courses may carry over in length as every dog is different and may need more sessions than others. Every course has a typical completion time listed for client convenience, however this course length estimation is not promised, as it typically varies from dog to dog.
Consistency & Homework Agreement
Consistency and frequent training are essential to dog training and our programs heavily rely on these training sessions. If clients miss training sessions or assessments it can hinder their dogs ability to complete their training course.
I understand that if I am not consistent and honest about assessments, training, and homework that course completion may be pushed back, or I may achieve incomplete training as a result.
I understand that Tricks for treats is considerate of missed homework and assessments, and will do their best to reschedule when possible to make sure I am getting my desired training results, however: if I (the client) miss two weeks (fourteen (14) days) of training Tricks For Treats reserves the right to deny training and discontinue service
Visual and Audio Recording Agreement
I grant Tricks For Treats, and its representatives, owners, trainers, and employees, the right to take photographs or videos (including audio recording) of me and/or my pet while during Tricks For Treats training and competitions, and to copyright, use and publish said Media in print and/or electronically for any and all lawful purposes, including for commercial purposes, advertising, and the purpose of trade.
I specifically consent to the digital compositing or distortion of the Media, including, for example, any changes or alterations as to color, size, shape, perspective, context, foreground or background, speed of playback and incorporating any other audio, video, or photographic materials which were not part of the Media as originally created. I waive any right that I may have to inspect or approve any finished product or products or the advertising copy or printed matter that may be derived from or used in connection with the Media, or any right to approve or disapprove of the use to which it may be applied. I agree that the Media, and any reproductions or altered versions shall be deemed to represent an imaginary person and/or animal unless my name or the name of my pet is used. I further agree that Tricks For Treats may use the Media to illustrate any wording or description, and agree that no such wording shall be considered to be attributed to me or my pet personally unless my name or the name of my pet is used.
I further agree that Tricks For Treats may grant free licenses for others to use the Media under any model license published by Creative Commons. I hereby waive and agree not to assert any publicity, privacy, or other similar personality rights against any Creative Commons licensee using the Media so long as (1) that licensee is acting within the scope of that license, (2) that licensee does not use the Media for a pornographic or defamatory purpose, and (3) personal information concerning myself or my pets are not associated with the Media by the licensee, except as to personal information which was already included in the materials as licensed by Tricks For Treats (e.g., if my name or the name of my pet was used in the original materials than that name does not need to be removed by the licensee).
Privacy Policy
Tricks For Treats collects a variety of information from you when you sign up for services, visit our website, make purchases, or interact with us on social media. We use this information to provide you with up-to-date information as quickly and efficiently as possible.
Tricks For Treats will never share any sensitive information without your written approval.
Payments, Cancellations, & Refunds Policy
All Initial Consultations or One-Time Services:
No Payment is required to book all First Consultations (Meet & Greet)
Cancellations may be made without penalty up to 3 hours prior to the consultation start time, however a consultation can only be canceled up to three times: If the consultation is canceled a fourth time Tricks For Treats reserves the right to deny consultations and or further training to clients.
All Sessions:
If a payment is missed or canceled, all Tricks For Treats Jax training will be paused, and client will be given 72 hours to make this payment to continue training, alternatively client can opt to suspend training for a maximum of two weeks. If a client has not reinstated their subscription following the two week ( fourteen (14) days) grace period, Tricks For Treats Jax reserves the right to deny consultations and or further training to clients.
Cancellation & Refunds:
Under no circumstances are refunds given on services that have already been used. Training subscriptions are non-refundable, final sale from the time of purchase. The only instance in which a refund may be given is if we have completed two weeks of training, your dog was then deemed unworkable, untrainable, or uncontrollable and/or we have informed you that we will be terminating your course and discontinuing training. All packages last the dog's lifetime unless the course is for a specific age range or your dog no longer meets that course's eligibility requirements.
By signing this waiver, you consent to have us charge your credit card for course subscription payments, order purchases, additional training or services, one time training sessions, virtual sessions or one time virtual sessions.
I understand and agree that if I cancel my subscription at any time prior to my training course completion Tricks For Treats responsibility to train and trainer’s duties shall terminate, no refunds will be given for previous work or that current weeks payment, and that all other provisions of this Agreement shall continue in full force and effect.
Entire Agreement, Severability, Written Modification Required Agreement
This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Trainer regarding the matters described above. This Agreement may be amended only by a written instrument signed by both Client and Trainer. If any term of this Agreement is to any extent illegal, otherwise invalid, or incapable of being enforced, such term shall be excluded to the extent of such invalidity or unenforceability; all other terms hereof shall remain in full force and effect; and, to the extent permitted and possible, the invalid or unenforceable term shall be deemed replaced by a term that is valid and enforceable and that comes closest to expressing the intention of such invalid or unenforceable term.
